Register my Food Business

To register your Food Business, you will need to complete the following registration form:

Prior to granting registration as required under the Food Act 1984, The Environmental Health Unit must be satisfied that:

  • A copy of a plan layout and specifications of the proposed business must be submitted with the application form.
  • The floor plan must include the location of all fixtures, equipment and furniture.
  • Specifications of various materials to be used on floors, walls, ceilings, benches, and shelves must be included in the plan.
  • Submit a comprehensive list of proposed food to be made and sold from the premises.

What happens after you apply?

After assessing your plans, an Environmental Health Officer will contact you to organise a plans approval inspection (if required) and discuss:

  • any non-compliant items
  • any details that require clarification or more information
  • any additional costs that may be incurred, and
  • options and suggestions that may resolve any issues

This will be followed up with an email summarising the discussion and confirming inspection time.

Progress and final inspection of the Food Premises

Once you have had your plans approval inspection, undertaken any required works or provided further information, you will need to contact the Council’s Environmental Health Officer to arrange for on-site inspection to ensure that the construction and fit-out is completed satisfactorily and in accordance with the food safety standards. Please contact Council at least 5-business days prior to the inspection to allow for appointment scheduling.

Once the final inspection has been conducted and all registration requirements have been finalised, a Certificate of Registration will be sent to your nominated address. You can begin trading once you have received your certificate.

Planning and Building Requirements for Food Businesses

The Planning and Environment Act 1987 regulates land use and development, while the Building Act 1993 governs building construction.

All food business (whether from home, a formal shopfront, or a mobile vehicle), must comply with the Hindmarsh Planning Scheme. We strongly encourage you to check the zoning of your intended location using the Community Map.

Food premises operating from home must meet the requirements of a home-based business. Alternatively, If your property is in a General Residential Zone or Township Zone, you may be able to apply for a planning permit to operate a food and drink premises. However, takeaway food premises are prohibited in the General Residential Zone unless the property directly adjoins Transport Zone 2.

In the Commercial Zone, a planning permit may not be required to operate a food premises. However, some structural works may require planning approval. In all cases, structural building works will require building approval.
